USA: A police officer was fired for assault during a traffic control

One of them was expelled from the body police officers in Virginia who are accused of attacking a U.S. Army lieutenant after being stopped for rolling control during which they marked him with their weapons and threw pepper spray at him, according to an official announcement, reports APE.

Officer Joe Gutierrez was fired after an investigation concluded that he did not follow the prescribed procedure, the authorities of the city of Windsor in Virginia announced yesterday, the American media.

The statement did not say whether the other police officer involved in the incident, Daniel Crocker, was punished.

Lieutenant Caron Nazario filed a lawsuit April 2 in Norfolk, Virginia. USA complaining that the two police officers used violence when they stopped him on December 5, 2020 for a traffic violation. According to him, the police marked him with their weapons, threw him on the ground, sprayed him with pepper spray and “threatened to kill me”.

Nazario, an African-American of Latin descent, claims in his lawsuit that Guterres and Crocker violated his constitutional rights.

Earlier Sunday, Virginia Gov. Ralph Northham announced that he had called for an independent police investigation into the incident and the actions of the two officers.

Northam commented that the video from the incident “angered him”.

On December 5, Nazario was wearing his military uniform and driving his new SUV with a temporary paper plate that was visible on the rear window of the vehicle when he was signaled to stop on the side of a highway.

According to the lawsuit filed by Nazario, he turned on his car’s turn signal, slowed down and looked for a lighted spot to stop. However, one of the police officers used the radio saying that a driver of a vehicle without license plates “escapes the police” and is considered “high risk” and another police officer arrived at the scene.

Nazario stopped at a nearby gas station less than two minutes after being signaled to stop. During the search, which was recorded by cameras on Nazari’s police uniforms and cell phone, the lieutenant told police he was afraid to get out of his car. A policeman answered him. “Yes, you are doing well and you are afraid”, it is emphasized in the lawsuit.

One of the police officers also indirectly threatened Nazarios with an electric shock.

During the arrest, Nazario had his hands up, he did not show any resistance, but the police threw pepper spray at him and threw him violently on the ground. Eventually, the local police chief arrived at the scene and the lieutenant was released without charge, the lawsuit added.
