“Abrego Garcia was not in the initial manifesto of the Flight of Title 8 to be removed to El Salvador,” said Robert Cerna, interim director of the ICE Field Office, referring to the Federal Immigration Law. “Instead, he was an alternate. As others were removed from the flight for several reasons, he climbed the list being designated for the flight. The manifesto did not indicate that Vague Garcia should not be removed.”
The statement continued to state that “by administrative error, Abugo-Garcia was removed from the United States to El Salvador. This was a carelessness, and the removal was carried out in good faith based on the existence of a final order of removal and the alleged affiliation of Abrego-Garcia to MS-13”.
Administration has argued that he cannot bring him back because he is in Salvadorenha custody and crumbled that he will probably be tortured or killed at Cecot.
