USA: The Supreme Court acquitted a high school coach who was fired because he did a group catechism to students

The Supreme Court on USA few days after the prohibition of abortiondecided to vindicate one coachwho lost his job because he did a group Christian catechism to the students he was coaching.

According to Reuters, the judges voted 6 to 3 in favor of Joseph Kennedy. The latter was until 2015 assistant coach, part-time, at a school in Bemerton. It has since become the banner of conservative Christians.

Thus, the six conservative judges acquitted Kennedy while the three progressives voted against.

According to the reasoning of the decision, drafted by Judge Neil Gorsac, the Supreme Court rejects the concerns of the school district that in a public school Kennedy’s prayers and Christian speeches could be seen as a “coercion” of students or a government embrace of a particular religion, which is prohibited by the First Amendment to the Constitution.

The chronicle of the case

The Supreme Court ruled that Kennedy’s actions were protected by his own rights under this very First Amendment, which protects freedom of speech and religion. The judges thus overturned the lower court decision drawn up with the school district. Kennedy was fired in 2015 after repeatedly disobeying instructions from his superiors to stop praying on the pitch and rejecting their suggestions to use other, private, spaces within the school as an alternative.

The Bremerton School District argued that Kennedy “performed” with his prayers and speeches, invited students to participate and tried to get media attention by acting as a civil servant. Some parents complained that their children felt compelled to participate.

Last year, the 9th San Francisco Court of Appeals ruled against Kennedy, saying local officials would violate the First Amendment if they allowed him to continue praying. The coach’s lawyers demanded that he be reinstated, accusing the school of discrimination and violating his right to freedom of speech.

It is noted that since the beginning of the year, the Supreme Court has taken a number of decisions on religious rights. On June 21, in a case involving the State of Maine, he advocated the use of state funds for students to attend religious schools. On May 2, he called for a Christian organization to raise a flag of the organization with the cross at Boston City Hall. On March 24, he ordered Texas to fulfill the wish of a death row inmate, who asked his pastor to touch him and pray aloud for him at the time of his execution.
