Judge Benjamim Acácio de Moura e Costa, of the Court of Justice of Paraná, defended the freedom and the closure of the case of the Bolsonarista who killed the former treasurer of the Workers’ Party (PT), Marcelo Arruda, in July 2022.
Criminal police officer Jorge Guaranho entered Marcelo’s 50th birthday party and shot the victim several times who was also armed and reacted with more shots. In a hearing held in September this year, the judge states that Jorge acted in self defense and that a complaint should not have been made.
“I do not, under any circumstances, rule out the self-defense of this case. In this case, there is no consistent element for the complaint under no circumstances”, he argues.
At the time, Jorge was at the scene, but left with his family in his car. Upon returning, he pointed the gun at the PT member, who did the same, and then the shooting began. According to judge Benjamim, “the right thing would be for him to get out of the car and I’ve already shot everything I can think of at him “.
He states that Marcelo Arruda was a bold person and a “violent human being “. “For me, it is the typical case of criminal imprisonment. Because it’s kill or be killed, it’s always self-defense.”
The hearing dealt with a request for habeas corpus from Jorge Guaranho’s defense, represented by lawyer Samir Mattar Assad. The defendant was arrested at the Curitiba Penal Medical Complex until then.
Benjamim Costa was defeated and the defendant was ordered to house arrest. In his vote, he also states: “I, with all humility, will use the divergence, and it is a humanitarian issue for us to give him freedom. I vote to grant habeas corpus and would block criminal proceedings “.
Jorge’s defense had already raised the defendant’s health issues, which were worsening in prison. The judge agreed with the defense: “The survivor… seems to be a soft mouth he no longer has control of his face. There was a reduction in his virility as a man, he became a wimp.”

Marcelo Arruda’s widow, Pamela Silva, filed a disciplinary complaint with the National Council of Justice (CNJ) for judge Benjamim to be sanctioned for attacking “unreasonably the honor of the victim and his family”, exceeding the limits of freedom of expression.
The complaint was sent to the CNJ at the end of October. In the same month, the agency accepted the request and determined that the The Internal Affairs Division of the Paraná Court of Justice thoroughly investigates the facts.

On July 9, 2022, Jorge Guaranho invaded Marcelo Arruda’s celebration after learning that the party’s theme was the Workers’ Party.
Guaranho shot Marcelo several times, who was also armed and reacted with more shots. Guaranho was then attacked by several people at the scene.
After the exchange of gunfire between the two, Marcelo was seriously injured and needed to be rescued. The next day, on July 10, he did not survive and died.
The accused was arrested and currently remains a defendant for the murder. He was also fired from the position he held before the crime as a federal agent at the Catanduvas prison, in the Cascavel region, in Paraná.
