War in Ukraine: Among the “crimes of the EU” is the violation of restrictive measures

The Council of Ministers unanimously approved a decision to add the violation of restrictive measures to the list of “crimes of EU» contained in the Treaty on the Functioning of the EU.

The EU has adopted series of restrictive measures in the context of Russia’s war of aggression against Ukraine and it is important that these measures are fully implemented, says a statement from the Council.

Currently, member states have different definitions of what constitutes a breach of restrictive measures and what penalties should be imposed in the event of a breach, the Council statement said. As he points out it could lead to varying degrees of enforcement of sanctions and a risk of circumvention of these measures, potentially allowing sanctioned persons to continue to access their assets and support regimes targeted by EU measures.

The inclusion of the breach of restrictive measures in the list of “EU crimes” it is the first of two steps to ensure a similar level of enforcement across the EU and to prevent attempts to circumvent or violate EU measures, reports the APE-MPE correspondent.

After the issuance of this decision the European Commission will submit a proposal for a directive containing minimum rules on the definition of criminal offenses and penalties for breaching EU restrictive measures. This draft directive will then have to be discussed and approved by the Council and the European Parliament.
