After the decision of the São Paulo Court of Justice (TJSP), by 8th Public Finance Court, to maintain the banning the motorcycle taxi service in the city of São Paulo, company 99 must continue with the modality. “ANDThis decision in no way interferes with our operation, in our legal understanding, we will continue to operate normally in the city”, Bruno Rossini, communications director at 99, in an interview with CNN .
The company’s director said that, with the São Paulo city council’s position of “inspecting the vehicles”, 99 went to court with a writ of mandamus to guarantee the operation without interference from the municipality. “We aimed to protect 99Moto’s operation against this type of coercive action,” he said.
On the afternoon of this Wednesday (15), judge Josué Vilela Pimentel denied the company’s request and also notified 99 to interrupt the activity. The court reinforced the validity of the Decree Municipal n. 62.144/2023, which temporarily suspended the use of motorcycles for paid individual passenger transport via app in the city of São Paulo.
In the decision, the judge also reinforces the conclusion of a municipality report that does not recommend the modality in the city, for risk to public health due to accidents and which has traffic that “cannot be compared to that of any other municipality in the country”.
The company claims to operate in more than 3,300 cities, which 40 million Brazilians used the motorcycle service offered and, in 2024, only 0.003% of races by motorcyclists recorded traffic accidents. “We will continue to operate normally”, he states.

Let’s appeal to the São Paulo Court of Justice (TJSP) to protect ourselves and continue fighting for our rights, those of our users and our drivers
Bruno Rossini, communications director at 99
The company understands that it can and should provide passenger transport services by motorcycle in Brazil, based on Federal Law 12,009 of 2009. The city of São Paulo stated that the Court’s decision is a victory for the municipality.
