Minister Rosa Weber, of the Federal Supreme Court, determined that the Chamber of Deputies, the Senate and the Presidency of the Republic must express their views on the approval of the PEC for precatories within five days.
The decision took place in a lawsuit filed by the Brazilian Bar Association challenging the constitutional amendment approved in Congress altering the payment regime for precatories (debts after court convictions) in the country.
The order, which is customary, was signed on February 15 and published in the STF this Monday (21). The deadline for manifestation starts counting from the notification of each of the parties, which has not yet occurred, according to the STF system.
After the information from the Presidency, the Chamber and the Senate, the minister determined that the case be sent to the Attorney General’s Office and the Attorney General’s Office, who will have three days to express themselves.
“Information is required from the Chamber of Deputies, the Federal Senate and the President of the Republic, to be provided within five days. Afterwards, the Attorney General of the Union and the Attorney General of the Republic, successively, within a period of three days”, he determined.
The OAB filed a lawsuit in the STF questioning the constitutionality of the PEC of the precatories.According to the OAB, the amendment “violates fundamental rights and guarantees to the conformation of the Principle of Separation of Powers and to the Democratic State of Law itself”.
