What changes with the new law that bans cell phones in schools in SP

The new law that prohibits the use of cell phones and electronic devices in schools in the state of São Paulo, public and private, was approved this Tuesday (12).

The favorable vote was unanimous among all deputies of the Legislative Assembly of the State of São Paulo (Alesp). The sanction of Governor Tarcísio de Freitas (Republicans) to validate the law remains pending.

PL 293/2024 revokes Law 12,730, of October 2007, which already prohibited cell phones in schools, but only during class hours.

The project authored by state deputy Marina Helou (Network) restricts the device in class period . According to the text, it is considered “class period” the student’s entire stay at school.

This includes breaks between classes, recess and extracurricular activities. The law also explains that, in addition to cell phones, any electronic devices Those with internet access will be prohibited: cell phones, tablets, smart watches and other similar equipment.

The law is valid for basic education institutions: early childhood education, primary education and secondary education.

Because of the lack of individual means of communication, legislation establishes that public and private schools “should create accessible channels for communication between parents, guardians and the educational institution”.

Students who decide to take their electronic devices to school must leave them stored, but without accessing them during class time.

According to the law, the school itself must provide storage throughout school hours.

If the law is approved – which depends on Tarcísio’s sanction –, São Paulo will become the first state to adopt such a measure beyond class hours.

Despite the ban, the use of electronic devices will be permitted exclusively in case of pedagogical needs in the classroom or for students with disabilities who require technological assistance to participate in school activities.
