São Paulo City Hall created, in 2023, a Working Group to carry out analyzes on the use of motorcycle services in individual transport, known as motorcycle taxis, in the capital. After 13 meetings, in which they discussed data and scenarios the conclusion was that the implementation of this transport model would be a big risk for public health.
During the meetings, experts from the CET, Municipal Health Department (SMS), Fire Department, SPTrans, Abraciclo and representatives of application companies, such as 99 and Uber among others, who presented elements to reach the decision presented.
Among the aspects analyzed, we considered, for example, the number of fatal accidents involving motorcycles . Furthermore, SMS data that points to motorcyclists as those who more are hospitalized in traffic incidents and the fact that passengers use the driver as a support, which changes the balance point of those who drive, also were taken into consideration.
The conclusion of the report prepared by the Working Group is that motorcyclists carry out lots of trips throughout the day, the risk of accidents would increase which would put danger to life himself, his passengers and everyone else involved in traffic.
Given the situation, the company 99 has positioned itself informing that it requested a writ of mandamus to protect the rights of the company and its passengers and motorcyclists “in the face of threats from the City of São Paulo against the legal functioning of the service”.
“99Moto has been operating since 2022, having made more than 1 billion trips in around 3,300 municipalities. 99 clarifies that City Hall can regulate the activity with specific rules for the location, but cannot prohibit a category that is permitted by federal legislation. This understanding is corroborated by 20 court decisions throughout Brazil. The company remains open to dialogue with the City Hall to collaborate with future regulations that are within the competence of the Municipal Power, as we have always been”, reports the company in a note.
