Four years after a tragic childbirth experience experienced by an Iowa couple, justice has come.

The couple sued gynecologists and Mercy Hospital in Iowa.

According to the family’s lawyer, doctors and nurses are accused of negligence, as they gave birth to the baby with mishandling, with tweezers and a suction cup, as a result of which they crushed his fragile skull. The child will now have to live with permanent brain damage. And the family should take care of it as long as it lives.

What exactly had happened

Kathleen Kromphardt was admitted to the hospital emergency department shortly after her waters broke. An hour later, the fetus showed signs of discomfort. Although staff took steps to intervene, the fetus was already depleted of oxygen while still in the womb. He eventually suffered from cerebral hypoxia.

In an effort to bring it into the world as quickly as possible, hospital staff used specific instruments that made the situation even worse.

“The doctor grabbed the forceps and tried to pull the baby out of the womb, dissolving the skull like an egg shell,” said the family’s lawyer. “And when he saw that the baby was not coming out, he used the suction cup, which is forbidden when the forceps have failed.”

The condition of the baby is uncertain

The baby was then taken to Iowa University Hospital for further testing. There the doctors diagnosed the cracked skull. But that was not the only problem.

Doctors also found that the baby was suffering from cerebral hemorrhage, as well as personal nerve palsy, seizures and ischemic brain damage. Today, the child suffers the consequences of these injuries, while he has also been diagnosed with cerebral palsy. Little Scott will need 24-hour care for the rest of his life.

The justification of the family

After a 14-day trial, the family’s lawyers concluded that it was three big mistakes made and responsible for the child’s condition. The first is that the doctors proceeded with a normal delivery, instead of choosing an emergency caesarean section, if the baby was in danger. The second is the excessive pressure exerted with the tweezers. And the third is the misuse of the suction cup that led to the rupture of the skull.

If all this had not happened, the parents believe that the baby would not have such serious and long-term problems.

After meeting for 90 full minutes, judges and prosecutors concluded compensation of 97.4 million euros to the parents. It is the highest ever judged in the state.

Parents say they are satisfied with this result. However, the hospital and the doctors’s side believe that he has been wronged and will do everything he can to reduce the amount of the fine to be paid.
