Υπ. Working in bad weather: A reminder of business obligations and employee rights

The Ministry of Labor and Social Affairs reminds the obligation of employers to take measures for the health and safety of their employees and to ensure that, according to the current legislation, they do not endanger their employees during the performance of their duties. At the same time, he clarifies that any complaints made to the Labor Inspection Body (SEPE) for the violation of the safety and health measures of the employees will be examined immediately with the required attention and rigor.

Also, in a statement, the Ministry of Labor and Social Affairs states that in cases such as the current bad weather, the following have been applied for years:

“1. When the company operates normally and an employee fails to return to work, despite the effort made by him, due to force majeure, he owes the salary of that day.

2. If companies employ employees in external jobs, they should be arranged in such a way that the employees are protected from adverse weather conditions and the necessary prevention and protection measures are taken in the case of employees belonging to high-risk groups (e.g. x. heart patients).

3. In the case of technical and construction works, as well as the works in the ports, the works are stopped, when they are immediately hindered by the weather conditions and are repeated, after the restoration of safe working conditions. In any case, it is forbidden to install or use lifting equipment in weather conditions that may endanger their stability, and must be re-checked by the supervising engineer supports, excavations, etc., before resuming work that has stopped, due to frost.

4. Finally, with regard to employer companies, including digital platforms employing distributors, both in the catering and other two-wheeled transport / distribution activities, it should be emphasized that employers should, if they have not already done so, , to immediately supply the distributors with the appropriate protection equipment (helmet, gloves, waterproof protection suit, etc.). “In addition to providing the necessary personal protective equipment, employers must also, in accordance with the provisions in force, immediately stop work in the event of extreme weather conditions (snowfall, frost).”
