BC changes rules on Pix participant infractions and penalties

O Banco CentralĀ (BC) changed rules that deal with infractions and penalties for participants who violate the terms of the regulation of the Pix, BC’s instant payment system.

According to the autarchy, a notification process for the offender is now provided for so that he adopts or ceases a certain practice. “This measure aims to speed up the conduct correction process”, he explained.
To avoid a recurrence of the conduct or omission, when applicable, the institution must present to the BC an action plan contemplating the proposed measures and the corresponding deadlines for their implementation.

The resolution with the changes was published this Friday (12) in the Official Gazette of the Union.

The possibility of exemption from fines was also changed. According to BC, it is now limited to infractions of low criticality and impact, as long as the requirements contained in the notification are met; it is adopted, at the participant’s initiative, the repair of any damage caused to other Pix participants; and the infraction is not repeated within a period of less than one year.

Pix’s regulations provide for penalties and even suspensions in cases of irregularities, with fines ranging from R$50,000 to R$1 million. To regulate the conditions for using the tool, the BC drew up a Penalty Manual.
