Belgian media: The government will remove the gender reference from the identities

The Belgian federal government will remove the gender reference from Belgian identities, according to reports in the Belgian press.

In 2019, the Constitutional Court annulled provisions of the law on transgender people as “unjustifiably restrictive”, stressing that they are therefore discriminatory. The Court ruled that the binary categories, male or female, for gender registration on the birth certificate were incomplete.

According to the French newspaper Le Soir, the Belgian federal government intended to resolve this unconstitutional aspect, but it was not clear how to proceed at this stage. One option was to specify a gender with the “X” symbol on an ID, but eventually the government decided to remove the gender reference on the ID card. The Ministers of Justice, Home Affairs and the Minister for Equal Opportunities have jointly drafted a bill on this issue. Technical aspects also need to be considered, including the impact of this abolition on travel and the distribution of this new identity. However, the representative of the Minister of Equal Opportunities stated that the government wants to move forward quickly with the issue.
