Concessionaires evaluate legal measures against suspension of toll adjustment in SP

The Brazilian Association of Highway Concessionaires (ABCR) said this Thursday (30) that the decision by the government of São Paulo to suspend the application of readjustments to tolls on concession roads is a cause of “serious concern” for the sector.

Earlier, the State Department of Logistics and Transport announced that, this year, marked by elections, it will not readjust toll rates, despite contracts providing for the change in values ​​from Friday (1st).

“The sector expresses serious concern about the adoption of the announced measure, at a critical moment in which companies are still facing the economic effects of Covid-19 and the significant increase in the price of inputs, and they have to honor important commitments assumed with financiers and suppliers, as well as with São Paulo society and users”, stated ABCR in a press release.

The entity demanded the implementation of “effective measures for the immediate financial compensation of contracts” and stated that the sector is evaluating “possible adoption of judicial measures”.

The readjustments that should have been applied would be 10.72% for contracts indexed to the IGP-M and 11.73% for those pegged to the IPCA, according to the state government.

The decision affects a number of companies in the sector, including CCR and Ecorodovias. When contacted, CCR stated that it “has a position aligned with ABCR” and Ecorodovias did not respond.
