The four men convicted in the Kiss Nightclub fire trial last Friday (10) surrendered to court and have already been sent to the penitentiary system after minister Luiz Fux, president of the Federal Supreme Court (STF), overturning a habeas corpus preventive of the defendants.
Kiss club partners Elissandro Callegaro Spohr and Mauro Londero Hoffmann, Banda Gurizada Fandangueira vocalist Marcelo de Jesus dos Santos and music producer Luciano Bonilha Leão were sentenced in the trial of the tragedy that happened on January 27, 2013, in Santa Maria, in Rio Grande do Sul.
Luciano and Marcelo were sent to the São Vicente do Sul state prison, about 90km from Santa Maria. Elissandro, also known as Kiko, is at the Canoas Penitentiary Complex (RS), while Mauro Hoffmann was taken to the Tijucas prison unit, in Santa Catarina.
Marcelo and Elissandro had already presented themselves to court soon after Fux’s decision.
The four accused were sentenced by judge Orlando Faccini Neto, from RS. The convictions would be valid from your ad. However, a preventive habeas corpus, granted by Judge Manuel José Martinez Lucas of the Rio Grande do Sul Court of Justice (TJRS), to one of the defendants prevented the immediate fulfillment of the sentences, which were as follows:
- Elissandro Callegaro Spohr (club partner): 22 years and 6 months of confinement
- Mauro Londero Hoffmann (also a partner): 19 years and 6 months of confinement
- Marcelo de Jesus dos Santos (vocalist for the band Gurizada Fandangueira): 18 years of confinement
- Luciano Bonilha Leão (band assistant): 18 years of confinement
The disaster, which killed 242 people and left 636 injured, began on the stage, where the band Gurizada Fandangueira was performing, after a fireworks show. The flames soon spread, causing a lot of toxic smoke. One of the members fired a pyrotechnic device, hitting part of the building’s roof, which caught fire.
