Justice authorized, on the morning of this Tuesday (21), that the 11-year-old child, pregnant as a result of rape, in Santa Catarina, return to her home, according to information from the family’s lawyer, Daniela Felix. The authorities await the position of the Children’s Court forwarded by the Court of Justice.
Also according to Felix, the girl’s release was authorized because it was identified that the aggressor is not in the house where she lives.
The case was revealed in a report published by journalists Paula Guimarães, Bruna de Lara and Tatiana Dias, from Portal Catarinas and Intercept Brasil.
The victim of sexual abuse was taken to a hospital in Florianópolis to perform an abortion, after the pregnancy was confirmed. The institution, however, refused to perform the procedure because the pregnancy had exceeded the limit of weeks allowed by internal rules.
When the case came to court, magistrate Joana Ribeiro Zimmer ordered the girl to be taken to a shelter, using as a justification in one of the orders the “risk” of the mother performing “some procedure to operate the baby’s death”.
Although Zimmer cited the “risk of the baby’s death” to justify the victim’s going to a shelter, the Public Ministry of Santa Catarina (MPSC) states that the request for provisional shelter was made “with the sole objective” of putting the child at risk. child safe from possible further abuse.
