Court orders demolition of wall blocking access to the beach in Pernambuco

The Pernambuco Court of Justice (TJPE) decided to immediately demolish a 250-meter wall built with coconut tree trunks on Pontal de Maracaípe beach, in Ipojuca, on the south coast of Pernambuco. The decision was made last Tuesday (22).

The court order responds to a request presented by the State Agency for the Environment and Water Resources (CPRH) and imposes a daily fine of R$10,000 in case of non-compliance.

The wall was erected in May 2023 by a businessman who owns land in the area.

Since then, traders, residents and tourists have reported difficulties accessing the beach. For visitors, the construction compromises not only access, but also the aesthetic value of the region, known for its biodiversity, including mangroves and restinga vegetation.

In 2022, CPRH granted authorization for the construction of the wall, but this license was later revoked due to environmental irregularities identified by Ibama.

In the new decision, the case’s rapporteur, judge Fernando Cerqueira, highlighted that the structure advanced onto the beach and caused damage to local tourism.

With the TJPE’s determination, it is expected that the wall will be demolished soon, ensuring public access to the beach and complying with the region’s environmental standards. The structure was built by the Fragoso family, owner of the land, who obtained favorable decisions for construction in court.

Wanted by CNN João Fragoso, owner of the property, was asked to comment on the situation, but has not commented so far.
