The European Union Court of Justice ruled on Wednesday (15) to cancel a 997 million euro ($1.04 billion) antitrust fine given to Qualcomm for payments made by the company to Apple for the exclusive use of its microchips. .
The court said the European Commission, the EU’s executive arm, had committed a series of wrongdoings during the case against the San Diego-based company, which supplies chips for phones, cars and other devices.
The court’s statement said that “various procedural irregularities” affected Qualcomm’s right of defense and invalidated the European Commission’s analysis of the case.
The fine had been imposed in early 2018 by the bloc’s antitrust chief, Margrethe Vestager, on the grounds that Qualcomm abused its market dominance by paying Apple billions between 2011 and 2016 on the condition that it did not buy. from other companies, harming competition.
The illegal payments were made directly, not through discounts, the EU said. At the time, Qualcomm had said it strongly disagreed with the decision and would appeal.
