Former Kiss nightclub partner, convicted of the tragedy, returns to prison

Mauro Londero Hoffmann, former partner of Boate Kiss and one of the four people responsible for the fire that occurred in 2013, was arrested again on Tuesday morning (3) in Rio Grande do Sul, after a reversal of the jury’s annulment.

Elissandro Callegaro Spohr, also a partner in the nightclub at the time, as well as Luciano Augusto Bonilha Leão and Marcelo de Jesus dos Santos had to return to prison this week after Minister Dias Toffoli, of the Federal Supreme Court (STF), overturned, on Monday (2), the decisions that annulled the jury of the Kiss Nightclub tragedy.

With the decision, the immediate return to prison of the four defendants convicted in the case was determined.

The Kiss Nightclub jury had been annulled by the Rio Grande do Sul Court of Justice in August 2022, after the defenses of those convicted pointed out irregularities in the progress of the process.

According to the defendants’ representatives, errors in the selection of jurors and possible damage in the preparation of the trial questions were some of the irregularities that occurred.

After the court’s overturn, the four people responsible for the nightclub fire, which resulted in the deaths of 242 people, were released from prison.

In September 2023, the 6th Panel of the Superior Court of Justice (STJ) upheld the annulment of the jury. Months later, in February of this year, a second trial was scheduled, but was suspended again by Minister Toffoli, after a request from the Public Prosecutor’s Office of Rio Grande do Sul.

Mauro Londero Hoffmann, a partner in the nightclub, had previously been sentenced to 19 years and 6 months in prison for simple homicide with eventual intent, a situation in which the person involved assumes the risk of causing someone’s death, even without the direct intention of doing so.

Hoffmann underwent a custody hearing on Tuesday morning (3) and was then sent to prison. Elissandro Callegar, Luciano Augusto and Marcelo de Jesus had already been in prison since yesterday.

Remember the case

On January 27, 2013, 242 people died after a fire broke out at the “Boate Kiss” nightclub. In total, around 636 people were injured in the tragedy.

The use of pyrotechnic devices inside the nightclub during a musical performance is believed to have caused the fire. At the time, sparks from flares hit the soundproofing foam located on the ceiling of the venue, which resulted in the fire spreading rapidly and generating toxic smoke.

Most of the victims died of suffocation due to the smoke. The incident is considered the biggest tragedy in Rio Grande do Sul and the second biggest in the country in terms of the number of victims in a fire.
