From a pro-democracy act to visits to Brasília: 12 points of opposition to Josué Silva at Fiesp

CNN had access to the list of questions sent to the president of Fiesp, Josué Gomes, by the opposition and made at the meeting organized by the opposition to him this Monday (16).

There are twelve questions. Part of them seeks to link Josué to president-elect Luiz Inácio Lula da Silva. Another part addresses issues related to Josué’s management, such as administrative choices and hiring.

On politics, for example, one of the main criticisms is the one that asks him to clarify whether the manifesto for democracy read at the USP Faculty of Law on August 11 “would have been previously debated and obtained the approval of the elected board for such conduct, in order to represent the legitimate interest of the categories represented by Fiesp, since that act indicated a clear political position of the entity and that, for the moment, would have gained contours of political and institutional positioning, due to its importance”.

He also questioned him about visits to Brasília and criticisms made of the previous management of Fiesp, by Paulo Skaf, aligned with former president Jair Bolsonaro.

According to Josué’s interlocutors, he answered these points at the meeting this Monday and then left the place with his supporters.

But his opponents considered the responses unsatisfactory and, after his departure, opened a new assembly and approved his removal.

There were 47 votes in favor of removing him from office in a universe of 112 employers’ unions.

Allies of Josué told CNN that the impeachment has no legal validity because no legal rites referring to this assembly were fulfilled.

Josué assumed the presidency of Fiesp in place of Paulo Skaf, appointed as the political operator of the movement to remove him.

Josué is the son of José Alencar, who was Lula’s deputy between 2003 and 2010 and is close to the PT. Skaf, in turn, is close to former president Jair Bolsonaro.

Law following all 12 requests for clarification made to Joshua:

1 – Considering that Fiesp is a representative body of the industrial sector, with vigorous flags and claims and being certain that many of the issues debated originate in the National Congress and Federal Executive and considering that the President of the entity is considered the most representative figure of the institution, in accordance with articles 2, I and 18 of its Statute, please [Josué Gomes] to relate the on-site visits to the Federal Capital with the Fiesp agenda;

2 – Clarify and justify the participation (or not) of unions in councils and departments, to represent the real interest and participation of the productive class in Fiesp’s studies and strategic actions;

3 – Clarify the position and function of Mr. Antonio Machado at Fiesp. Until recently, said person occupied a room attached to the presidential office, using the Federation’s facilities and people, with full access to the president and holding meetings with the presidents of thematic councils and other employees of the Federation, including giving orders and guidelines to the administrative staff, being able to exposing the entity to labor liabilities and also having access to information pertinent only to this Federation;

4 – Clarify and inform if you have authorized any president of the Thematic Council of Fiesp, or head director of a department appointed, by you or by a company with some connection, to sign a service provision contract with this Federation, or if you receive any financial aid in projects or sponsorships directly or indirectly.

If the answer is yes, we request the provision of copies of documents and detailed reports of the effective provision of services or projects;

5 – Clarify and justify the article published on March 13, 2022, in the newspaper Folha de São Paulo, entitled “Industry must foster new ideas”, where you. asserts that “We still have to worry about commercial arbitration. Despite the fact that the practice has been consolidated over the last 20 years, we still face a serious, but manageable, crisis of reliability in the system.

”It is a public and well-known fact that the Arbitration Chamber of Fiesp/Ciesp, enjoys prestige and RELIABILITY in the market, being considered one of the best Arbitration Chambers in Brazil, having under its responsibility hundreds of cases in judgment and chaired by the Hon. Dr. Sydney Sanches, Retired Justice and Former President of the Federal Supreme Court.

Said article discredits the Arbitration Chamber, raising doubts about the reliability of the arbitration system, in addition to discredit and damage to its image;

6 – Clarify the reasons why the manifesto entitled “In Defense of Democracy and Justice” was prepared and published by Fiesp on the occasion of the acts of August 11th.

Please clarify if the affiliated Unions were consulted regarding the content of the text published by Fiesp and if they had the opportunity to debate and deliberate on the subject.

Please also clarify whether the text published by Fiesp would have been previously debated and obtained the endorsement of the board elected for such conduct, in order to represent the legitimate interest of the categories represented by Fiesp, since such act indicated a clear political position of the entity and which, for the moment, would have gained contours of political and institutional positioning, due to its importance;

7 – Please detail the number of interviews given to the communication organs, in favor of the defense and effective representation of the industrial economic category of the base of Fiesp;

8 – Please detail the role and position held by Mr. Wilson Risolia, appointed as Corporate and Educational Strategies Director, clarifying the position and insertion in Senai’s regulations, since Fiesp is responsible for administering and supervising the Seis and Senai System by law;

9 – Please justify your understanding. about Fiesp’s electoral process, behold, in the meeting of directors and union presidents, held on November 07 pp, in the hybrid format, V. Sa. questioned the electoral system of this federation, labeling it anti-democratic.

On the occasion, he used the following expressions, referring to the federation’s electoral statute and forecasts: “to not have democracy”, “to not have a dispute”, “the entity’s first mistake”, “does not allow debate”, “does not allow dispute ” and “Paulo Skaf chose me”.

The statement denotes contempt for the electoral process that elected him and total contempt for the electoral college and the commission of jurists who ensured the fairness of the entire electoral process. Still on the electoral system, V. Sa. stated that the “design is configured so that there is no real dispute, nor democracy”, and casting doubt on the system that elected him.

Next, V. Sa. commented, at that meeting, that the electoral system of the entity is “a mistake” for not allowing the composition of more than one slate. However, taking into account that the base of the Federation has thousands of businessmen, such as you, in sufficient numbers to compose countless plates – a fact proven in several disputes, your attack. the electoral diploma must be clarified, since it generates enormous insecurity and undermines the image of Fiesp and configures disrespect, even for members of the slate and other participants in the electoral process;

10 – At the same meeting, you witnessed and did not rebuke the act of manifest machismo and misogyny, practiced by Mr. Synésio Batista da Costa, who referred to women as disqualified people and compared them to motor vehicles when he said that “I am a buyer of champagne from a woman who separates from her husband.

11 – Also, at the same meeting on November 7 pp, the same Mr. Synésio Batista da Costa, referred to this entity several times, using the pejorative term “bagasse”, as something without any value. Again, there was no reproachful conduct on your part, this is why the signatories, at this time, expressly require clarification and measures;

12 – At the ill-fated meeting of November 7 pp, Your Honor. also reported that it hired (at its expense) legal advice from lawyers José Francisco Siqueira Neto, who sponsors more than a hundred lawsuits against Fiesp and unions affiliated to the federation, which reveals an absolute conflict of interests worthy of clarification. , V.S. justify the type of hiring and advice requested.
