Lewandowski confirms new hearing to discuss ownership of Fernando de Noronha

Minister Ricardo Lewandowski, of the Federal Supreme Court (STF), confirmed for June 27 a new conciliation hearing in an action in which the Union asks that federal ownership over the Fernando de Noronha Archipelago be recognized.

“Continuing the work towards a consensual solution to the conflict, the parties are summoned to appear in person at the hearing already scheduled for June 27, 2022, to be held at the Federal Supreme Court”, said the minister.

In March, the federal government filed a lawsuit in the STF asking for the federalization of the territory of Fernando de Noronha, which today belongs to the state of Pernambuco.

On May 27, in the first hearing, the parties only started negotiations for a consensual solution to the conflict.

In the document, presented by the Attorney General’s Office (AGU), the government alleges that Pernambuco “has been failing to comply with the terms of the contract and hindering the work of the Secretariat for the Coordination and Governance of Federal Heritage and federal environmental agencies in the management of the area” .

The AGU also requests that it be declared that “the domain over the Fernando de Noronha Archipelago is fully owned by the Federal Government” and that the STF determine “the State of Pernambuco to immediately comply with the entire content of the Assignment of Use Agreement under Special Conditions of Fernando de Noronha Island”.
