Man arrested on suspicion of illegal adoption of newborn in Minas Gerais

A 52-year-old man was arrested by the Civil Police of Minas Gerais (PCMG) last Wednesday (22) in Belo Horizonte, suspected of registering someone else’s child in his name. According to the police, the action constitutes the crime of alleged childbirth, provided for in article 242 of the Penal Code.

The agents discovered the action after an anonymous tip, as reported by delegate Carolina Bechelany, head of the State Department of Investigation, Guidance and Family Protection (Defam).

“We received information that a mother admitted to a hospital in the Tupi B neighborhood was negotiating the handover of her newborn child to a third party. This type of practice is considered a crime and harms the legal adoption system,” said the delegate.

According to the delegate responsible for the investigation, Diego Lopes, from the Specialized Police Station for the Protection of Children and Adolescents (Depca), the baby’s mother lives in a vulnerable situation and had agreed with the suspect and his wife to hand over the child so that the couple raised her as their own. “The man registered the baby as his son, but yesterday morning (22) the real father appeared at the hospital and discovered the situation”, detailed Lopes.

According to the head of the Specialized Division for Guidance and Protection of Children and Adolescents (Dopcad), delegate Renata Ribeiro Fagundes, as soon as the complaint reached the police station, the teams went to the location to investigate the situation.

“We were able to identify that the man had already registered the baby as his, using false information. He was located near the hospital and arrested in the act”, explained Renata.

The child’s mother was also heard and stated that she decided to hand over the baby due to the family’s financial situation.

“In cases like this, the guidance is to go to the hospital and inform the intention of giving the child up for adoption legally, guaranteeing the rights of the newborn and avoiding criminal implications”, added the head of Dopcad.

Investigations into the case continue to see if there are others involved. So far, investigations have revealed that the suspect paid for an ultrasound examination of the pregnant woman, but no evidence was found that payment was made for the delivery of the child.

The crime for which the suspect was charged carries a prison sentence of two to six years.
