A man reported by the Public Prosecution Service of the State of Bahia (MPBA) for rape of vulnerable and theft against a reveler During the Salvador Carnival of 2024 was sentenced to 10 years, 8 months and 10 days in prison.
The sentence, delivered on the 20th, was released on Thursday (6) by the MP. The crime occurred on the morning of February 14, 2024, Ash Wednesday. The decision is still on appeal.
According to prosecutors Elmir Duclerc and Márcia Teixeira, the victim, a tourist from Brasilia, left a cabin in the Barra-Ondina circuit and, in a state of drunkenness, took an alleged motorcycle taxi.
Upon noticing the state of the woman, the pilot transported her to a different hotel than she had asked, where she practiced the crimes. After the abuse, the man fled. According to MPBA, the victim, unable to resist the attack due to his drunkenness, woke up alone in an unknown place.
The complaint was made by MPBA, after investigations carried out by the Civil Police, with support from the Tourist Protection Police Station (Deltur) and the Special Police Station for Women’s Assistance (DEAM). Police used images from Barra-Ondina circuit security cameras and witness testimonials, such as hotel staff and a taxi driver, to identify the responsible motorcycle taxi driver.
Prosecutor Marcia Teixeira, head of the Prosecutor’s Office specialized in defending the LGBTQIA+population, stressed that the conviction was rapid due to the victim’s stance.
“This conviction, in less than a year, is due to the fact that the victim denounced the crime, of being submitted to expert examinations, fulfilled all the protocols of evidence, being accepted and attended by the police authorities and the Public Prosecution Service, ”explained the prosecutor. She pointed out that, in this case, the victim’s vulnerability was characterized by the state of drunkenness.
In a press release, Marcia Teixeira stressed the importance of victims of sexual violence immediately seeking the nearest police station or a specialized police station, to ensure medical, social and psychological care, as well as referral to the necessary expertise.
If you choose to seek care at a health unit initially, victims should require the fact to be immediately reported to the nearest police station. If the victim is a child or adolescent, it is essential that the case is also notified to the region’s Guardianship Council.
The prosecutor also recalled that the care for preventing unwanted pregnancy and sexually transmitted infections (ISTS/HIV) should occur up to 72 hours after violence. If you have difficulty getting attendance or the victim needs more information, the Bahia Public Prosecutor can be sought by number 127 or by the site https://atencio.mpba.mp.br/denuncia- General, to register any crime even after the record of the police report.
