Minister André Mendonça, of the Federal Supreme Court, rejected analyzing a request from the Brazilian Democratic Movement (MDB) against a rule by the Superior Electoral Court (TSE) that unified the voting time in this year’s elections and adopted the official time in Brasília as a national parameter. .
According to the party, this sudden change would result in great inconvenience and real difficulties for the organization of the elections and for the population in general.
For the minister, there was no offense to the Constitution. “There is, therefore, the control of the legality of the regulatory power of the Electoral Justice. In my opinion, it is up to the constitutional jurisdiction to defer to the decision-making body endowed with expertise for the organization and holding of elections”, said the minister.
In December 2021, the Superior Electoral Court (TSE) unanimously decided that, in the 2022 General Elections, the voting start time would be standardized by Brasília time in all states and the Federal District. Ministers reviewed draft resolutions.
In the 2022 elections, polling stations will open at 8 am and close at 5 pm Brasília time, as long as there are no voters in the queue. As a consequence, states with a time zone different from the capital will have to adapt to the measure.
The states of Amazonas, Rondônia, Mato Grosso do Sul, Roraima and Mato Grosso will start voting one hour earlier, taking into account local time. In the state of Acre, voting will begin two hours earlier and, in Fernando de Noronha, one hour later, maintaining the same number of hours for voting in all states.
