NGOs report police operation in Vila Cruzeiro to the Organization of American States

Social institutions and non-governmental organizations (NGOs) denounced to the Inter-American Commission on Human Rights, an organ of the Organization of American States (IACHR/OAS), the police operation that left 25 dead in the community of Vila Cruzeiro, in the North Zone of Rio de Janeiro, last Tuesday (24th).

The bodies are asking the commissioner to follow up on the investigations and to collect responses from the authorities about the action that left the second highest number of dead in such an incursion in the state. The data are from the Study Group on New Illegalisms at the Fluminense Federal University (GENI/UFF), in Niterói, Metropolitan Region of Rio de Janeiro.

The action only caused fewer deaths than the Jacarezinho operation, in May 2021, when 28 people died. Last year’s incursion is remembered by the entities’ document, which also highlights the performance of two federal agencies in Tuesday’s action: the Federal Highway Police (PRF) and the Federal Police (PF). However, as there are still six wounded hospitalized, the death toll could still rise.

The document recalls that the Argument of Noncompliance with a Fundamental Precept (ADPF) 635, in the Federal Supreme Court (STF), restricts the conditions for carrying out operations in communities in the state during the Covid-19 pandemic. In the piece, they also ask the IACHR to comment on the operation and monitor situations of violence in the state.

The request, signed by Justiça Global, Observatório das Favelas, Casa Fluminense, Instituto Marielle Franco, Instituto da Mulher Negra (Geledés) and Instituto Raça Igualdade e Direitos Humanos, also requests that the IACHR, based in Washington, in the United States, cover state and federal authorities to investigate the circumstances in which the operation took place and any signs of torture, as well as possible alterations to the crime scenes.

The piece also requests investigations carried out by the Public Ministry (MP-RJ) and the Federal Public Ministry (MPF). The bodies reported that they had already opened an investigative procedure to investigate the case. The entities also ask that the IACHR maintain direct communication with the Brazilian government to question the measures adopted to combat police violence.

After the operation, on Tuesday, the Military Police issued a note, in which they defended the legitimacy of the action, but acknowledged that the incursion was not a success. “It is not possible to consider an operation with a death result to be successful, especially involving the loss of the life of an innocent person,” the corporation said in an excerpt from the statement.

The innocent named by the police note is Gabriele Ferreira da Cunha, 41, who was hit by a stray bullet inside her house.
