Minister Nunes Marques, president of the 2nd Panel of the Federal Supreme Court (STF), called for this Friday (10) an extraordinary session of the virtual plenary to analyze his decision that annulled the impeachment imposed on deputy Valdevan de Jesus Santos, known as Valdevan Ninety.
The session will start at 00:00 and end at 23:59. The ministers will analyze whether or not to maintain the decision of Nunes Marques, which restored the parliamentary mandate.
The president of the Chamber of Deputies, Arthur Lira (PP-AL), this Friday (3) removed deputy Márcio Macêdo (PT-SE), who had held the position for just over a month, and ordered the return of José Valdevan de Jesus, the Valdevan Ninety (PL-SE). The parliamentarian had been impeached by the Superior Electoral Court (TSE) in March this year for abuse of economic power during the 2018 election campaign.
Lira’s decision was taken a day after the minister of the Federal Supreme Court (STF) Kassio Nunes Marques suspended Valdevan’s impeachment. In the document, the president of the House determined the “immediate removal” of Macêdo so that Valdevan Noventa could resume his mandate in “compliance with the decision rendered” by the minister of the Supreme Court.
Valdevan was convicted of irregular fundraising for the campaign. Residents of Sergipe municipalities were pressured to simulate donations to the candidate.
The investigation showed dozens of donations of BRL 1,050, made at the same bank branch and in the next few days.
According to Nunes Marques, the TSE judgment has not yet been published, which would not have allowed Valdevan’s defense to file an appeal against the Electoral Court’s judgment.
“This is a flagrant restriction of defense, violating the fundamental guarantee of due process of law. It is unreasonable for the applicant to be penalized for the execution of the collegiate decision without giving him the opportunity to have the constitutionally guaranteed appeal instrument”, he observed.
