News officially approved those for parental leave which come from the decree dismissed by the Council of Ministers. The possibility for fathers to stay at home with their children for 10 days is permanent and there are other news.
For employees the months of compensated parental leave rose from six to nine. They can be used up to the age of 12 of the child, not up to the age of 6 (currently you can receive an allowance up to the sixth year of the child’s life, equal to 30% of the salary up to a maximum of six months of the parents together). The amount does not change, but each parent is entitled to three months, non-transferable, for a total period of six months plus another three, which can be transferred between parents and can be used alternatively between them. The leave extends up to 11 months for the single parent.
For self-employed and professionals the right to daily allowance is extended in the event of a high-risk pregnancy up to two months before the birth. They are now entitled to maternity allowance for the period from two months prior to three months after the date of birth. The value is 80% of the five twelfths of the professional income reported to the tax authorities for professional women and 80% of the minimum daily wage of agricultural workers to self-employed women.
The 10-day mandatory paternity leave. The father can use them between the two months preceding the birth and up to the following five days. The alternative paternity leave remains and cannot be substituted for this, which can be used in serious cases of death, infirmity or abandonment of the child by the mother.
They have been established sanctions for employers who obstruct the use of mandatory paternity leave. Those who use it will be able to obtain gender equality certification. Advantages arrive for public and private employers who enter into agreements to give priority to access to smart working for workers with children up to 12 years of age or without any age limit in case of disability.
