The Federal Police launched Operation False Illness against a scheme of using false medical reports for Income Tax exemption, on the morning of this Wednesday (17). The action was carried out together with the Federal Revenue Service.
The agents carried out a search and seizure warrant and court orders prohibiting the absence of the country and handing over the passport to the Federal Court within five days. The measures were issued by the 11th Federal Court of Porto Alegre.
The investigation found 287 taxpayers, holders of around 1,200 Personal Income Tax declarations, who unduly requested refunds totaling more than R$20 million, considering the fiscal years 2018 to 2022.
This morning’s searches aimed to obtain new evidence for the case and identify the possible involvement of other people in the fraudulent scheme. So far, the police are investigating crimes against the tax system, use of false documents and false identity.
The scheme
The investigation began based on reports of incidents involving several taxpayers. After receiving a notification from the Federal Revenue Service that the medical reports submitted to obtain income tax exemption were false, they reported hiring the same tax consultant, who falsely identified himself as a lawyer.
According to the PF, the suspect presented false medical reports to the Federal Revenue Service with non-existent diseases or conditions of these taxpayers.
Both official medical boards and the experts indicated as signatories of the reports acknowledged the falsity of the documents. See flowchart from the diagram below.
