RJ: Survivor of massacre at Realengo school will receive R$ 30,000 in compensation

A survivor of the Massacre of Realengo, which took place in April 2011, at the Tasso da Silveira Municipal School, will receive R$ 30,000 from the City of Rio de Janeiro, following a decision by the judge Claudio de Mello Tavares, from the 18th Chamber of Private Law.

The then student, who was 12 years old at the time of the incident, alleges that he suffered material and moral damages for having experienced the attack, in which Wellington Menezes de Oliveira, 23 years old, shot dead twelve students and injured ten others.

He mentions that he had to hide with colleagues during the massacre, which caused him trauma and intense fear, making it necessary to refer him to psychological support.

Compensation of R$ 500,000 was requested, as well as free legal aid and the cost of psychological treatment. The state of Rio de Janeiro refuted the mention that it would be responsible in the case, “due to the absence of a specific act or omission attributable to it”.

The municipality also filed a defense, saying that the act happened due to an unforeseeable fact caused by a third party, and that no specific omission by the city hall was demonstrated.

The author presented a replica of the facts.

As a result, the request for the city of Rio to pay BRL 20,000 in pain and suffering was partially granted, plus default interest from the date of the attack and monetary correction from the publication of the sentence. Thus, the value was R$ 30 thousand.

Regarding the psychological treatment, the author of the action did not present proof for which he needed follow-up.

“Student safety is, therefore, an assumption of the educational activity itself conducted by the municipality of Rio de Janeiro, so that the failure to provide it is an obvious omission, perfectly identifiable”, quotes the judge.
