The messaging app Telegram has updated its terms of use and now provides for the delivery of IP address and phone number if it receives a court order from “democratic countries such as Brazil.”
“If Telegram receives a court order from a democratic country, such as Brazil, regarding the use of the public platform for activities prohibited by the Terms of Use – such as terrorism and abuse against children and adolescents – the IP addresses and telephone numbers of suspects can be made available to the competent authorities”, states the new term of use.
In addition to the aforementioned crimes, the term of use of the application also prohibits it from being used to “apply scams and send spam, promote violence on public channels and use of bots, illegal pornographic content on public channels and bots and abuse the platform to participate activities recognized as illegal by most countries.”
The app points out that “it is a secure service that protects activists and ordinary people from data monopolies and authoritarian governments.”
The update also restricts access to the app to those aged 16 and over for citizens of Brazil, European Union (EU) countries and the United Kingdom.
The updates come after Telegram aligns itself with the Superior Electoral Court (TSE) and the Federal Supreme Court (STF) against the dissemination of fake news related to the elections. The agreement signed with the TSE aims to combat false content related to the Electoral Justice, the electronic voting system, the electoral process at different stages and the actors involved.
The application ran the risk of being blocked in Brazil after not complying with decisions by Minister Alexandre de Moraes, of the STF, in March. The company’s CEO, Pavel Durov, alleged negligence on the part of the company, apologized and went on to promote changes in the operation and rules of use.
In March, Telegram deleted a post by President Jair Bolsonaro on his channel talking about an investigation by the Federal Police (PF) into an alleged hacker attack on the TSE – the publication was part of the pending issues listed by Moraes.
The TSE also signed an agreement with Telegram’s biggest competitor, WhatsApp.
