A new measure has been adopted by the government of Prime Minister Pedro Sanchez and enters into force today in Spain. This measure provides that those convicted of domestic or gender-based violence will not have the right to visit their minor children.
The amendment to the Spanish Penal Code provides that justice may deprive the visitor of the right to visit if the divorced parent who does not have custody of his or her children is found guilty of murder or attempted murder, assault or abuse of his or her partner or children, or if there is “reasonable evidence of family or gender-based violence “.
In some cases a judge may, however, allow visits or contact with the children “always taking into account their interest (…) and assessing the state of the relationship” between the parent and the child.

On April 27, the disappearance of two six- and one-year-old girls who had left with their father was announced. The body of one of them was found at sea in June, off the Canary Islands, at the bottom of the ocean in a bag that was tied by the anchor of a ship.
According to justice, the “most likely” scenario is that their father, who did not accept his separation from their mother, killed the children to “cause the greatest pain imaginable to his ex-partner”.
Spain is a pioneer in dealing with gender-based violence and in 2004 became the first European country to adopt legislation that considers the sex of the perpetrator to be an aggravating factor in attacks, as reported by Agence France-Presse and the Athens News Agency.
Also, since 2003, gynecological murders have been officially recorded in the country. Since then, 1,111 women have been killed by their ex-partners or current partners, 33 of them this year, according to official statistics.
