The State Duma will consider a bill to ban digital assets as a means of payment

Anatoly Aksakov, head of the State Duma committee on the financial market, introduced a draft law providing for a complete ban on the use of CFA and DSM in Russia to pay for goods and services.

Law Project called “On Amendments to Certain Legislative Acts of the Russian Federation Regarding the Regulation of the Turnover of Digital Financial Assets and Utility Digital Rights.”

The head of the committee, Aksakov, said that the authors of the initiative are seeking to increase the investment attractiveness of the use of digital rights by businesses. We are talking about investment platforms and information systems through which digital financial assets are issued. And also about preventing the use of digital financial assets (DFA) and utilitarian digital rights (DPR) as a means of payment.

“The changes are aimed at eliminating the risks of using DFA and DSP as a monetary surrogate by establishing a direct ban on the transfer or acceptance of DFA and DSP as a counter provision for goods transferred, work performed, services rendered, as well as another method that allows one to assume payment for DFA of goods (works) , services).

Control over the implementation of the law is assigned to the operators of the DFA exchange, information systems and investment platforms (crypto-exchanges).

If the fact of payment is established, the authors of the project write, the exchange operator is obliged to refuse to secure the transaction, and the operators of the information and investment platforms to ensure that the user cannot change the CFA records.

In addition, the authors of the project propose to grant operators of electronic platforms the right to settle transactions with DFA and DSM, as well as to recognize them as subjects of the national payment system. To control the procedure for settlements, all operators of electronic platforms must be included in the register of the Bank of Russia.

The Bank of Russia is vested with supervisory functions in relation to the national payment system, and the right to apply enforcement measures against operators of electronic platforms in cases of violations.

Earlier, Anatoly Aksakov told the guests of the Parliamentary Newspaper press center that the continuation of the active phase of the discussion on the methods of regulating the Russian cryptocurrency market does not allow us to expect a quick draft law.
