Osborne is expected to appear in court on Tuesday afternoon, according to WTHR. The show identified him as the boy’s father.

Beech Grove Mayor Dennis Buckley released a statement to WTHR saying he was “mortified” by the incident.

“As with all of you, I am mortified by what happened and am very grateful that no one was hurt, especially the baby. I appreciate the swift action taken by the Beech Grove Police Department to protect the baby and deal with the weapon in question.”

Video from a neighbor’s security camera that aired on “On Patrol: Live” shows a little boy in the entryway of an apartment complex swinging a gun back and forth and pulling the trigger.

According to a statement from the show, Beech Grove officers were called after a neighbor called 911 “stating that she and her son witnessed the child alone in the hallway outside her unit and that he was holding a gun and pointing at them

When the officers arrived, the alleged father of the baby stated that he did not have a gun. “I don’t have a gun, I never brought a gun to this house, if there is one, it’s my cousin’s,” said the man when agents entered his apartment.

Police searched the premises, finding the artifact under a television in the living room.

It’s unclear if it’s the same gun seen in the neighbor’s camera footage, but one of the officers on the scene reported that it’s a “Smith & Wesson SD9mm”.

Police can be seen leading the man, in handcuffs, out of the apartment complex.

A police officer explained, after speaking with the prosecutors on duty, that there was enough for an arrest “for child neglect”, as there was a loaded firearm in the apartment. “This is a crime,” he said.

THE CNN reached out to the Beech Grove Police Department, the Marion County District Attorney’s Office and the mayor’s office for comment and further information.

Osborne’s defense has not been located. THE CNN contacted the Public Defender’s Office for more information.
