Judge Rosita Falcão Maia, from the Court of Justice of Bahia (TJBA), generated controversy when she criticized the racial quota system during a hearing analyzing an appeal from a candidate who had signed up for the broad competition and later requested a change to the racial quota, last Wednesday (27). The phrase that caused the most controversy was “but unfortunately we have to comply with the law, and black people have the right to their quotas” .
In her statements, the judge stated that the quotas “came more to divide than to unite the population” and questioned the quality of teaching in public universities after the implementation of the affirmative policy.
Rosita also stated that “public universities were ‘top’ and today they are falling apart”, attributing this drop in quality to the quota system. See the video below:
The judge argued that access to universities and public service must be based on merit, regardless of race: “I think that meritocracy in universities, in public courses, is extremely important, whatever color the candidate is. It is extremely important that we have competent people in the public service, in universities, in medical school, in law. And this is not happening in public universities.”
Finally, he argued that, although there is a historical debt with the black population, the quota policy is not the appropriate way to repair it: “I think we do have a big debt with black people, but that’s not why we if paid. In Brazil, people have always looked for the easiest solution. This was the easiest (quotas), but it is not the solution. On the contrary, a big problem was created.”
In response, the Bahia Bar Association repudiated the judge’s statements, arguing that they go against the principle of equality and disregard data that prove the effectiveness of quota policies. The OAB-BA highlighted that quota students have shown better academic results, refuting the judge’s statement about the drop in the quality of teaching.
The Union of Auxiliary Services Servers of the Judiciary of the State of Bahia also issued a note of repudiation against the judge’s statements, highlighting that “the quota system is an affirmative policy, arising from the struggle of black movements, and aims to promote equality of opportunities”. And he criticized the statement about meritocracy, arguing that “reducing inequality is not a merit, because not everyone has access to the same opportunities”.
