VoePass, the airline responsible for the plane that crashed last Friday (9) in Vinhedo, in the interior of São Paulo, has already contacted its insurance company to compensate the families of the victims of the accident. The disaster left 62 dead.
According to the company, the insurer is dealing with each family individually. The bodies of all victims have already been removed from the accident site and taken to the central Legal Medical Institute (IML) in the capital of São Paulo. So far, 12 have been identified and 8 have already been released.
According to the Public Defender’s Office of Paraná, which is following the investigations together with the Public Defender’s Office of São Paulo, when a ‘consumer accident’ occurs, as is the case with the crash of a commercial plane, the company’s liability for compensation is objective, that is, moral and material damages must be compensated regardless of the airline’s fault in the crash.
Moral damages are an estimate of the suffering caused by the loss of a family member. Material damages involve the loss of property, such as items that were in a suitcase, and loss of earnings, such as a monthly pension for life calculated based on the value of the deceased person’s monthly income and life expectancy.
The VoePass ATR 72-500 aircraft, registration PS-VPB, took off from Cascavel, in Paraná, and was heading to Guarulhos airport, in the metropolitan region of São Paulo, but crashed in Vinhedo, in the interior of São Paulo, after about an hour and a half of flight. All 62 people on board died, including 58 passengers and four crew members.
The Vinhedo Police Station has opened a police investigation into the plane crash. The Brazilian Air Force (FAB), through the Aeronautical Accident Investigation and Prevention Center (CENIPA), is also investigating what caused the plane to crash.
