In Germany, Apple accused of violating competition law

The German media, internet companies and representatives of the advertising business have all filed a complaint against Apple. They argue that the new privacy settings in iPhones constitute market abuse and violation of competition law.

The document was filed with the German Federal Cartel Authority amid Apple’s plans to implement a mechanism that requires users to consent to being tracked for advertising purposes.

“As a result of these unilateral measures, Apple is effectively depriving all competitors of the ability to process commercially sensitive data in its ecosystem,” several business associations said in a joint statement.

Apple claims that the new privacy framework, which will be contained in iOS 14, strictly protects personal privacy and European Union privacy laws.

“User data is theirs and they must decide whether to share their data and with whom,” Apple said in a statement.

“With iOS 14, we give users the choice of whether they want to allow apps to track them by linking their information to third-party data for advertising purposes or sharing their information with data brokers.”

The Federal Cartel Authority acknowledged receipt of the complaint and said it would be investigated. A similar complaint was dismissed by the French competition regulator last month.
