Libya’s appeals court has rejected an application against the candidacy of caretaker Prime Minister Abdul Hamid Dbeiba for Libya’s presidential election, according to reports Wednesday.
The powerful former interior minister Fati Basaga, who is said to be a member of the Muslim Brotherhood, was among several presidential candidates who appealed against Dbeiba’s candidacy. Opponents of Dibba say the prime minister did not resign three months before submitting his candidacy in accordance with the election law.
But the news platform Fawasil reported that a court in Tripoli had rejected Basaga’s appeal. According to the same source, Dbeiba will remain on the list of candidates for the December 24 elections.
The Tripoli Court of Appeal had agreed to examine the petitions.
But on Wednesday, “Dbeiba’s appeal was upheld, allowing him to run in the election,” his lawyer told reporters in court. He added that the decision was “final and can not be appealed”.
Libya’s presidential and parliamentary elections are set to take place on 24 December under a United Nations-sponsored agreement reached by Libyan political opponents during meetings in Tunisia on 15 November 2020.
