On July 19, the Community of Madrid published the award of a public contract for the amount of 397,861.20 euros for the provision of a “Vehicle service of up to 9 seats, including driver, and their drivers for health centers, COVID-19 “to the company Uber NV, based in the Netherlands, according to the Taxi Project 2.O association.

The complaint indicates that, with this public contract, the company provides a service in Spain, which is “a new indication of the alleged commission by the Uber group of companies of crimes against public finances and falsehood documentary film”. At the end of June, the Public Prosecutor’s Office began an investigation, following a complaint from the same taxi drivers association, against Uber for allegedly using a corporate network to avoid paying taxes.

Specifically, the complaint that the company does not declare as a transport service but as an application and transmission of information and that it is the drivers who pay taxes for their economic activity by equipping themselves with taxi drivers. Thus, with each service Uber charges between 20 and 30% to the user for the computer application and that this amount presumably “it is diverted to Uber Holland and from there to tax havens “, such as Singapore or Caribbean countries, so “of that percentage neither Corporation Tax nor VAT is being taxed.” In this way, the complainants, who analyzed the company’s 2018 fiscal year, believe that 5.1 million euros could be defrauded that year, although the amount could be higher since the company operates in Spain since 2014.

Now, Taxi Project 2.0, represented by Vosseler Abogados, considers that the award by the Community of Madrid is a new indication of this alleged crime against the Public Treasury since it would confirm that the Uber group “has been providing transport services in Spain , through different companies in its group, without paying properly“. That is why the complainants believe that these companies have been created” precisely for tax evasion by concealing the true activity of the group: land transport activity in Spain “and that is why they consider that the Prosecutor’s Office should investigate whether committed the crime.
